In response to a congressional request, the Office of lnspector General initiated two
related evaluations regarding home health agencies 'HHAs' employment of individuals with
criminal convictions.
This memorandum report presents the results of the first evaluation,
conducted to

- Identify State background-check requirements for HHAs.
- Identify the
types of criminal convictions that, under State law or regulation, disqualify individuals for
HHA employment.
The second evaluation, entitled Home Health Agencies Employment of
Individuals With Criminal Convictions, will
- Determine the extent to
which HHAs employed individuals with criminal convictions as of January 1, 2014, and identify
criminal convictions of selected employees that potentially disqualify them for HHA
employment, and (
- Identify the procedures that HHAs use to perform background checks on
prospective and/or current employees.
